These General Terms and Conditions of Sale (GTCS) apply to all orders placed on the Une Belle Photo website, accessible at unebellephoto.com.

Article 1 – Purpose
The purpose of these GTCS is to define the rights and obligations of the Seller and the customer regarding the online sale of fine art photographs, decorative prints, artistic creations, and associated products offered on the Une Belle Photo website.
Any order placed on the website implies prior and unreserved acceptance of these GTCS.
The applicable GTCS are those in effect on the date the order is confirmed.
These GTCS are primarily intended for consumers acting for purposes outside the scope of their professional activity.
Article 2 – Products
The products offered for sale are those displayed on the Une Belle Photo website at the time of browsing.
Each product is accompanied by a description indicating, depending on the specific product, its format, medium, printing method, framing, and main characteristics.
The photographs displayed on the website are intended to showcase the artworks as accurately as possible. However, slight differences in appearance may exist between the image displayed on the screen and the printed product, particularly due to the settings and characteristics of individual screens.
The Seller reserves the right to modify its catalog, formats, media, or technical specifications at any time. Such modifications do not apply to orders that have already been confirmed. Some works may be offered as limited, signed editions. In such cases, the number of copies and the signing details are indicated on the relevant product page.
Article 3 – Prices Prices are quoted in euros (€).
Where VAT is not applicable, the relevant legal notice is displayed on the website and on commercial documents.
The price applicable to the order is the price displayed on the website at the time the order is confirmed.
The Seller reserves the right to change prices at any time. However, a price change will not affect an order that has already been confirmed.
Any applicable delivery charges are indicated before final confirmation of the order.
Article 4 – Ordering
The customer selects the product(s) they wish to order and adds them to their shopping cart.
Before finally confirming the order, the customer may review the contents of their shopping cart, the selected products, quantities, delivery address, and the total order amount.
The customer must verify the accuracy of the information provided before confirming the order.
Confirming the order implies acceptance of these General Terms and Conditions of Sale and constitutes an obligation to pay.
The order becomes final once confirmed and payment has been accepted.
An order confirmation is sent to the customer electronically, provided an email address has been supplied.
The Seller reserves the right to refuse or cancel an order in the event of exceptional issues regarding product availability, a manifest pricing error, or suspected fraud.
In the event of a cancellation attributable to the Seller, any amounts paid by the customer will be refunded.
Article 5 – Payment
Payment is made at the time of the order using the payment methods offered on the site.
Depending on the options available at the time of the order, the site offers payment via PayPal and/or bank card (processed by Stripe), among others.
Bank card payments are processed via a secure payment interface.
The Seller does not have access to the customer's full banking details transmitted during payment.
The order is considered confirmed only after payment has been validated.
Article 6 – Delivery
Products are delivered to the address specified by the customer when placing the order.
Delivery terms, the carrier, and estimated delivery times are indicated on the site or during the ordering process.
Depending on the product, destination, and format ordered, delivery may be carried out by Mondial Relay, FedEx, UPS, or another carrier offered at the time of the order.
Where the service allows, the customer will receive tracking information for their parcel.
Delivery times indicated on product pages or during the ordering process are estimates.
In the event of a significant delay, the customer may contact the Seller for information regarding the status of their order.
In the event of loss or a delivery issue, the Seller will take the necessary steps with the carrier.
The customer is advised to check the condition of the parcel upon receipt and to promptly report any issues to the Seller.
Article 7 – Right of withdrawal
In accordance with the provisions of the Consumer Code, for distance sales, the consumer has a period of 14 days to exercise their right of withdrawal, without having to justify their decision or incur any costs other than those provided for by regulations.
For products, this period begins on the day the consumer—or a third party designated by them other than the carrier—takes physical possession of the goods.
The customer may exercise their right of withdrawal by sending the Seller, before the expiry of the period, an unequivocal statement expressing their decision to withdraw.

The customer may also use the withdrawal form provided at the end of these General Terms and Conditions of Sale.
After informing the Seller of their decision, the customer must return the product as soon as possible and, at the latest, within 14 days of communicating their decision to withdraw.
Direct return costs shall be borne by the customer, unless the Seller agrees to cover them or regulations require the Seller to bear them.
The customer is liable for any depreciation of the product resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the product.
Exceptions to the right of withdrawal
In accordance with regulations, the right of withdrawal may not apply, in particular, to goods made to the consumer's specifications or clearly personalized.
Where this exception applies to a specific product, this information must be communicated to the customer prior to the order.
Article 8 – Refund
In the event of a valid exercise of the right of withdrawal, the Seller shall refund the amounts paid by the customer in accordance with applicable legal provisions.
The refund shall be made no later than 14 days from the date on which the Seller is informed of the customer's decision to withdraw.
However, in the case of a sale of goods, the Seller may defer the refund until the product has been recovered or until the customer has provided proof of shipment of the goods, whichever occurs first.
The refund shall be made using the same payment method used for the transaction, unless the customer expressly agrees to a different method.
The customer shall not be required to accept a refund by cheque.
Article 9 – Statutory warranties
The products sold are covered by applicable statutory warranties, including:
the statutory warranty of conformity;
the statutory warranty against hidden defects.
The statutory warranty of conformity allows the consumer to take action within 2 years of the delivery of the goods. For new goods, the defect is presumed to have existed at the time of delivery for the 24 months following delivery, subject to exceptions provided by law.
In the event of a lack of conformity, the consumer may request that the goods be brought into conformity under the conditions set out in the Consumer Code, notably through repair or replacement where possible and in compliance with regulations.
The statutory warranty against hidden defects may also be invoked under the conditions set out in Articles 1641 et seq. of the Civil Code. Action must be taken within two years of the discovery of the defect, in accordance with the law.

Article 10 – Liability
The Seller shall not be held liable for any failure to perform or delay in performing an obligation resulting from an event of force majeure as defined by applicable regulations.
The Seller shall also not be held liable for damages resulting from improper use of the product by the customer or failure to follow any recommendations provided with the product.
The limitations set forth in this article shall not deprive the consumer of their statutory rights.
Article 11 – Intellectual Property
All elements present on the Une Belle Photo website—including photographs, artworks, graphic designs, texts, logos, videos, and visual elements—are protected by intellectual property laws.
Any reproduction, representation, modification, adaptation, distribution, or exploitation—whether in whole or in part—of the works and content on the site without the prior authorization of the rights holder is prohibited.
The purchase of a work does not transfer the copyright attached to that work to the customer.
Article 12 – Personal Data
Personal data collected during an order is used, in particular, to facilitate the processing, payment, delivery, and tracking of the order.
The Seller undertakes to process personal data in accordance with applicable regulations, specifically the General Data Protection Regulation (GDPR).
Subject to the conditions set out in the regulations, the customer has the right to access, rectify, erase, and restrict the processing of their data, as well as the right to object to processing and the right to data portability.

Article 13 – Cookies
The site may use cookies and other trackers necessary for its operation, as well as—where applicable—trackers subject to user consent.
Where consent is required, it is obtained in accordance with applicable regulations. Visitors can manage their cookie preferences using the features available on the site. The CNIL points out that trackers requiring consent must be subject to prior consent.

The Seller will endeavor to find an amicable solution with the customer.
Article 15 – Consumer Mediation
In accordance with the provisions applicable to consumer mediation, the consumer may—after having first submitted a written complaint to the Seller and failing an amicable resolution—refer the matter free of charge to the consumer mediator relevant to the Seller, under the conditions stipulated by regulations.

Article 16 – Applicable Law and Dispute Resolution
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the consumer is encouraged to seek an amicable solution with the Seller first.
Failing an amicable agreement, the consumer may pursue the remedies provided for by applicable regulations.
The rules regarding jurisdictional competence applicable to consumers are those provided by law.
This clause does not deprive the consumer of the jurisdictional rules legally applicable to them.
